By creating an account or using BotLaunch ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

BotLaunch is a platform that enables users to create, manage, and deploy Telegram bots. Our Service includes:

• Bot management dashboard
• 143+ pre-built modules
• AI-powered conversation features
• Analytics and reporting tools
• API access for custom integrations
• Customer support

3. Account Registration

To use our Service, you must:

• Be at least 16 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

You are responsible for maintaining the confidentiality of your account and password. Notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit spam, malware, or malicious content
• Harass, abuse, or harm other users
• Collect personal information without consent
• Attempt to gain unauthorized access to the Service
• Interfere with the proper functioning of the Service
• Use the Service for illegal activities
• Resell or redistribute the Service without authorization
• Create bots that violate Telegram's Terms of Service

Violation of these terms may result in immediate termination of your account without refund.

5. Subscription and Payments

Billing: Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms.

Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date. You can cancel at any time from your account settings.

Price Changes: We may change our prices with 30 days notice. Price changes will take effect at the next billing cycle.

Refunds: We offer a 30-day money-back guarantee for new subscribers. After 30 days, refunds are at our sole discretion.

Taxes: Prices do not include applicable taxes. You are responsible for paying any taxes associated with your use of the Service.

6. Intellectual Property

Our IP: The Service, including all content, features, and functionality, is owned by BotLaunch and protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of content you create using the Service. By using the Service, you grant us a license to host, store, and display your content as necessary to provide the Service.

Feedback: Any feedback, suggestions, or ideas you provide may be used by us without compensation or attribution.

7. API Usage

Access to our API is subject to the following terms:

• API usage is limited based on your subscription plan
• You must not exceed your allocated rate limits
• API credentials must be kept confidential
• You may not use the API to create a competing service
• We may modify or discontinue API features with notice

8. Service Availability

We strive to maintain 99.99% uptime but do not guarantee uninterrupted access to the Service. We may suspend the Service for:

• Scheduled maintenance (with advance notice when possible)
• Emergency repairs
• Factors beyond our control
• Compliance with legal requirements

Enterprise customers with SLA agreements are entitled to service credits as specified in their agreement.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not responsible for third-party services or content

10. Indemnification

You agree to indemnify and hold harmless BotLaunch, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

11. Termination

By You: You may terminate your account at any time through your account settings. Termination does not entitle you to a refund of any prepaid fees.

By Us: We may suspend or terminate your account immediately if you violate these Terms or engage in activities that harm the Service or other users.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. We may delete your data after 30 days unless required by law to retain it.

12. Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

Arbitration: Any disputes shall be resolved through binding arbitration in San Francisco, California, except for claims that may be brought in small claims court.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions.

13. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and BotLaunch
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• Waiver: Failure to enforce any provision does not constitute a waiver
• Assignment: You may not assign these Terms without our consent
